INFORMATION REGARDING PERSONAL DATA
We inform you that the controller of your personal data is ITS-AIM s.r.o., Hlucholazská 58, Mikulovice 79084, Czech Republic. This means we are responsible for using your data in a safe manner, in accordance with the agreement and applicable regulations.
§ 1
Personal data will be processed by ITS-AIM s.r.o., in particular:
1. Based on Article 6(1)(b) and (c) of the GDPR for the purpose of:
a. Taking steps prior to entering into a contract at the request of the data subject or performing a contract to which the data subject is a party (data necessary for contract conclusion is indicated on the contract form),
b. Complying with a legal obligation to which the Controller is subject;
2. Based on the legitimate interest of ITS-AIM s.r.o., i.e., under Article 6(1)(f) of the GDPR, for the purpose of:
a. Marketing its own products or services, including personalized offers based on customer profiles,
b. Organizing and conducting competitions and other marketing activities,
c. Pursuing or securing claims,
d. Conducting analyses of the technical quality of services and equipment,
e. Fulfilling our legal obligations, e.g.:
– Issuing and storing invoices and accounting documents,
– Responding to complaints within the time and manner prescribed by law.
§ 2
Data needed to fulfill legal obligations will be used:
a. For the time necessary to perform such obligations, e.g., issuing an invoice (legal basis: Article 6(1)(c) of the GDPR),
b. For the time required by law to retain such data, e.g., tax records,
c. For the period during which we may face legal consequences for failing to fulfill an obligation, e.g., receiving a financial penalty from state authorities (legal basis: Article 6(1)(f) of the GDPR),
d. For detecting and preventing fraud – for the duration of the contract and subsequently for the period after which claims arising from the contract expire, and in the event of pursuing claims or notifying authorities, for the duration of such proceedings (legal basis: our legitimate interest),
e. For establishing, defending, and pursuing claims, including selling our claims from the contract to another entity – for the period after which claims from the contract expire (legal basis: our legitimate interest),
f. For creating reports, statistical analyses for our internal needs, including marketing research, planning service development, and IT system enhancements – for the duration of the contract and no longer than the period after which claims from the contract expire (legal basis: our legitimate interest),
g. For verifying creditworthiness – for the period necessary to assess it when entering, renewing, or extending this or another contract and for resolving related complaints (legal basis: performance of a contract). This also applies to data obtained from other sources.
§ 3
Retention period for personal data
1. Personal data processed for the purpose of contract conclusion or performance and compliance with the Controller’s legal obligations will be retained for the duration of the contract and thereafter for the period necessary to:
a. Provide post-sale customer support (e.g., complaint handling),
b. Secure or pursue any claims of ITS-AIM s.r.o.,
c. Comply with the Controller’s legal obligations (e.g., arising from tax or accounting laws);
2. Personal data processed for marketing ITS-AIM s.r.o.’s products or services based on a legitimate interest will be processed until the data subject objects;
3. Personal data processed based on consent will be retained until the consent is withdrawn.
§ 4
Rights of the data subject
1. The right to access personal data, including obtaining confirmation of data processing and information about the processing,
2. The right to rectify data if processed data is inaccurate or incomplete,
3. The right to request the deletion of data,
4. The right to request restriction of data processing,
5. The right to data portability, including receiving personal data provided to the Controller and transmitting it to another controller,
6. The right to object to processing based on the Controller’s legitimate interest or direct marketing,
7. The right to lodge a complaint with the supervisory authority of the EU Member State of habitual residence, work, or alleged infringement,
8. The right to withdraw consent at any time (without affecting the lawfulness of processing based on consent before its withdrawal),
9. The right to request human intervention, express a position, and challenge automated decisions.

Complaints
You have the right to lodge a complaint with the President of the Personal Data Protection Office if you believe that the processing of your personal data violates legal regulations.
- Regulation (EU) 2016/679 of the European Parliament and Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, repealing Directive 95/46/EC (General Data Protection Regulation).
